This Digital Millennium Copyright Act (“DMCA”) policy (“Policy”) applies to the Spotizen.org website (“Website”), the “Spotify Premium APK” mobile application (“Mobile Application”), and any related products and services (collectively, “Services”). This Policy outlines how Spotizen.org (“Spotizen,” “we,” “us,” or “our”) addresses copyright infringement notifications and how you (“you” or “your”) may submit a copyright infringement complaint.

We prioritize the protection of intellectual property and expect our users and their authorized agents to do the same. It is our policy to expeditiously respond to clear notifications of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (“DMCA”) of 1998. The text of the DMCA can be found on the U.S. Copyright Office website.

What to Consider Before Submitting a Copyright Complaint

If you are unsure whether the material you are reporting is actually infringing, you may wish to consult an attorney before submitting a notification to us.

The DMCA requires you to provide personal information in your copyright infringement notification. If you have concerns about the privacy of your personal information, consider hiring an agent to report infringing material on your behalf.

Notifications of Infringement

If you are a copyright owner or an agent authorized to act on behalf of one, and you believe that any material available through our Services infringes upon your copyrights, you may submit a written copyright infringement notification (“Notification”) pursuant to the DMCA. You can use the contact details provided below. All Notifications must comply with DMCA requirements. You may refer to a DMCA takedown notice generator or similar services to ensure compliance with these requirements.

Filing a DMCA complaint initiates a legal process. Your complaint will be reviewed for accuracy, validity, and completeness. If the complaint meets these standards, we may respond by removing or restricting access to the allegedly infringing material, or by permanently terminating repeat infringers’ accounts. We may also, at our sole discretion, require a court order before taking any action. While a backup of a terminated account’s data may be requested, we may not be able to provide it, and we encourage you to maintain your own backups.

If we remove or restrict access to content or terminate an account in response to a Notification of alleged infringement, we will make a good-faith effort to contact the affected user with information about the removal or restriction, along with instructions for filing a counter-notification.

Notwithstanding any provision in this Policy, Spotizen reserves the right to take no action upon receipt of a DMCA copyright infringement notification if it fails to comply with all the DMCA requirements.

Counter-Notifications

A user who receives a copyright infringement Notification may submit a counter-notification pursuant to sections 512(g)(2) and (3) of the US Copyright Act. If you receive a copyright infringement Notification, it means that the material described in the Notification has been removed from our Services or access to it has been restricted. The Notification will contain information regarding the complaint we received.

To file a counter-notification, you must provide a written communication compliant with DMCA requirements.

If you are unsure whether certain material infringes another’s copyrights or whether it was mistakenly removed or restricted, you may wish to consult an attorney before filing a counter-notification.

Notwithstanding any provision in this Policy, Spotizen reserves the right to take no action upon receipt of a counter-notification. If we receive a counter-notification that complies with 17 U.S.C. § 512(g), we may forward it to the individual who filed the original Notification.

Changes and Amendments

We reserve the right to modify this Policy or its terms related to the Services at any time, at our discretion. When we do, we will revise the “Last Updated” date at the bottom of this page. We may also provide notice of changes in other ways at our discretion, such as through the contact information you have provided.

The updated version of this Policy will become effective immediately upon posting unless otherwise specified. Your continued use of the Services after the effective date of the revised Policy (or other act specified at that time) will constitute your consent to those changes.
